사용자위원 전원불참…최저임금 결정 시한 또 넘겨. No member of the user committee ... Hand over the deadline for the minimum wage

최저임금위원회가 2020년치 최저임금을 결정해 고용노동부에 제출해야 하는 법적인 시한 당일에 회의를 열었으나, 사용자 위원들의 전면 보이콧해 결과를 끌어내는 데 실패했다. 올해도 법을 어기는 상황이 된 가운데 박준식 최저임금위원장은 다음주까지 결론을 내겠다는 결의를 밝혔다.

최저임금위원회는 27일 오후 3시 정부세종청사 전원회의실에서 6차 전원회의를 열어 내년치 최저임금액 결정을 시도했으나 의결정족수를 채우지 못하고 1시간30분 만에 회의를 끝냈다. 이날 회의엔 전체 27명 위원 가운데 공익위원과 근로자 위원 9명씩 18명만 참석했다.

 최저임금법 17조는 “위원회가 의결을 할 때에는 근로자위원과 사용자위원 각 3분의 1 이상의 출석이 있어야 한다”고 규정한다. 어느 한 쪽의 일방적인 결정을 막기 위한 취지다.

사용자 위원들은 전날 열린 5차 전원회의에서 내년치 최저임금액을 시급과 월급 모두 병기하는 한편 업종별로 차등 적용하지 않고 단일액수로 발표키로 결정하자 이에 항의해 앞으로 회의에 불참을 선언한 바 있다.

이로써 최저임금위원회는 올해도 법적인 시한 안에 이듬해 최저임금액을 결정하는 데 실패했다. 최저임금법은 고용노동부가 최저임금위원회에 심의를 의뢰한 지 90일 안에 액수를 결정해 고용부에 제출해야 한다고 규정한다. 

고용부는 지난 3월29일 최저임금위원회에 심의를 의뢰했고, 이날이 90일째 되는 날이다. 최임위는 지난해에도 법적 시한(6월28일)을 훌쩍 넘긴 7월14일 새벽 사용자 위원과 민주노총 쪽 근로자 위원이 불참한 가운데 나머지 근로자 위원 6명과 공익위원 8명 등 14명이 모여 시급 8350원을 결정했다.

 최저임금법 17조 4항은 근로자위원과 사용자위원 각각 3분의1 이상이 출석해야 의결이 가능하다고 규정하면서도 ‘다만, 근로자위원이나 사용자위원이 2회 이상 출석요구를 받고도 정당한 이유 없이 출석하지 아니하는 경우에는 그러하지 아니하다’는 조건부 조항을 두고 있다. 지난해에는 사용자 위원이 11일, 12일 연속 회의에 들어오지 않아 14일 의결이 가능했다.

이날 회의 파행으로 2020년치 최저임금액을 얼마로 할지에 대한 논의는 시작도 하지 못했다. 양쪽이 동시에 최저임금 ‘요구안’을 제출해왔는데, 사용자 위원들이 빠진 탓에 근로자 위원들도 요구안을 제시하지 않았다. 노동자 위원 내부적으로는 5년째 1만원을 제시하는 방안을 논의 중이다. 사용자 위원들은 전날 두 가지 안건이 뜻대로 되지 않음에 따라 사상 첫 ‘최저임금 감액’ 카드를 검토 중인 것으로 알려졌다.

노동계에선 전날 사용자 위원들의 집단 퇴장과 이어진 회의 불참이 앞으로 이뤄질 내년치 최저임금액 협상 과정에서 인상률을 최대한 낮추려는 전술일 수 있다는 지적이 제기됐다. 청년유니온은 이날 성명을 내어 “사용자 위원들은 최저임금 법정 결정시한이 얼마 남지 않은 시점에서 결정단위와 업종별 차등적용을 포함해 결정금액까지 종합적으로 토론해 표결하자는 공익위원 측의 제안에도 최초 요구안(금액) 제출을 거부하고, 월급병기를 폐기와 업종별 차등적용을 부실한 근거로 주장하며 토론을 지연시키다가 표결 결과에 항의해 퇴장했다”며 “업종별 차등적용에 대해서 사용자 측은 법에서 허용되지 않는 5인 미만 사업장에 대한 차등적용 주장만을 일관하면서 실제 가능한 대안조차 제시하지 않았다”고 짚었다. 

근로자 위원인 김영민 청년유니온 사무처장은 이날 <한겨레>와 만나 “근로자 위원들이 업종별 차등 적용을 어떤 식으로 하자는 것인지 제안하라고 해도 사용자 위원들이 전혀 제시하지 않다 회의장을 나가버려 그 의도를 의심할 수밖에 없다”고 말했다.
